See,this is not necessarily about the power or the mandate that the president wields,but its all about acting in a manner that portrays fairness.
If by acting the way he acted will portray him as a dictator from many of the kenyan elites,this could be detrimental considering Jamaa's like Michuki,Nyachae just to mention but a few are seen to be very rigid and with colonial mentality.
I think MK is making one bladder after another and this might cost him the seat of power. He should relax and try to be more accomodative.

Should President Kibaki have consulted? Did he go against the spirit of the IPPG talks? Did the IPPG talks result in a tangible written down agreement/law or were they merely a gentleman's agreement?(sounds like an oxymoron-calling politicians gentlemen?-I digress?)
Anyway. The IPPG talks were politically instigated to set the tone for minimum constitutional reforms that the opposition parties and civil society felt were necessary before the elections. As a result,to forestall such a move being hijacked by the civil society,particularly the NCEC,KANU convened the IPPG talks. They resulted mainly in three things. The passing of the Constitution of Kenya (Amendment) Bill,Statute
Law (Repeals and Miscellaneous Amendments) Bill. These bills seemed to respond to demands for minimum reforms
before elections and,together with a third bill (the Constitution of Kenya Review Commission Bill,1997),came to be referred to as the IPPG package. There was no talk of political parties jointly discussing ECK commissioners with the President. However,AFTER the talks they did propose names to the President for consideration to the ECK appointment. SOME of those recommended were appointed. But,the talks were never about the ECK and no gentleman's agreement was made that future appointments would be through negotiation between parties.All resolutions passed by the IPPG were reduced into writing and proposed as bills to parliament.
Secondly,since 1997 both Presidents Moi and Kibaki have made appointments to the ECK. Commissioners have retired and /or passed on and their replacements made.No-one cried foul until early this year. why now? It makes good politics to scream for whatever reason in an election year no matter how silent you were previously on a similar issue.
Three: Should Kibaki have at least consulted the other two(well-three) presidential candidates? Maybe,if all they wanted was to have their egos stroked especially since they are so democratic themselves. I mean,considering they were sooooo democratic,they recently awarded themselves direct parliamentary nominations for their MP seats. Oh,by the way,who was consulted at the 'appointment' of the sixth member to the pentagon?

Ok,we know that these MPs never agrees on anything,especially when it comes to sharing,thats why the EAC appintments were a mess. However,its good to try and please other than acting as if no one else exists. Thats what Emilio did and it does not come out very well.
Sometimes bedding abit is important and can give a different reflection.

And due to the very nature of the PUBLIC mandate of managing the ELECTIONS...
it would be totally unwise to include interested parties....
in this spirit... due to the individual oath by the President to the sovereignty and good will of the Kenyans who elected him or not...
it is up to his discretion...
to choose Commissioners who.... to his estimation... will work for the benefit of the country...
and not of an INDIVIDUAL....

Let's be correct here,what we normal humans call consultation in the actual world is very different when it comes to politics. All that would have happened is sharing out of positions that will create a mess. If these idiots could not agree on the constitution after so many months,what makes you think they'll agree on the sharing? Will the commissioners who have other interests even be able to work together?

At this point we cannot assume that the president did not consult.He might have and decided to keep it secret or maybe he didn't consult the people you have in mind in which case it would still be okay coz there are 36 Million Kenyans whom he has a right to consult.Secondly,he swore to protect the constitution as an individual not collectively......

Is it legal for the President to have done so? Had the opposition displayed a spirit fostering consultations? Didn't these opposition (ex) MPs have a chance to have their issue legally entrenched?

Its sad that the term of the ECK Commissioners have to end just before the elections,and they can ONLY be renewed for a period of 5 years,as per the current constitution.
Kibaki is just following the constitution,the IPPG thingy was just a discussion,nothing was signed between the political parties,and well a majority of the parties at the time,are not in existence right now...
Truth be told we are still going to be in the same situation in 2012,if our constitution is not changed or ammended...
Life is not a problem to solve,but an adventure to pursue...
